Information on personal data processing - contact form

• The company TOPGAL a.s., Nádražní 2649/73, 785 01 Šternberk, ID No.: 258 58 891, registered in the public register kept at the Regional Court in Ostrava, Section B, Insert 2336 (hereinafter referred to as "Controller"), within the meaning of Regulation (EU) No. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "Regulation") processes the following personal data within the contact form:
• email address
• query
• IP address
• E-mail address and query will be processed for the purpose of answering the query, for a period of 6 months from the sending of the message in the contact form, unless a longer period of time is required by law or such retention is necessary for the purpose of protecting the rights and legally protected interests of the Controller. Such a procedure is provided for in Article 6(1)(b) and (f) of the Regulation.
• IP address will be processed for the purpose of preventing attacks on the Controller's servers for a period of 6 months from the last access to the Controller's web portal. Such a procedure is allowed by Article 6(1)(f) of the Regulation.
• The processing of personal data is carried out by the Administrator, however, personal data may also be processed for the Administrator by the following processors:
• The web hosting provider, WebSupport s.r.o., with registered office at Staré Grunty 12, 841 04 Bratislava, ID No.: 36 421 928,
• LiveAgent software provider, Quality Unit, LLC, 3616 Kirkwood Highway, Suite A #1130, Wilmington DE 19808
• or other providers of processing software, services and applications, but not currently used by the Administrator.
• Please note that under the Regulation you have the right to:
• require us to tell you what personal data we process about you,
• request access to this data and have it updated or corrected, or request a restriction on processing,
• request the company to delete your personal data - the company will delete the personal data if the deletion does not conflict with paragraph 1 of this information and the legitimate interests of the company,
• object to processing carried out on the basis of the legitimate interest of the Controller,
• request a copy of the personal data processed,

file a complaint with the Data Protection Authority and the right to effective judicial protection if he/she considers that his/her rights under the Regulation have been violated as a result of the processing of his/her personal data in breach of the Regulation.

Livechat - processing information

• TOPGAL Inc, with registered office at Nádražní 2649/73, 785 01 Šternberk, ID No.: 258 58 891, registered in the public register kept at the Regional Court in Ostrava, Section B, Insert 2336 (hereinafter referred to as the "Controller"), within the meaning of Regulation (EU) No. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "Regulation") processes the following personal data within the livechat:
• e-mail address
• query
• IP address
• E-mail address and query will be processed for the purpose of answering the query, for a period of 6 months from the date of sending the message in the live chat, unless a legal regulation requires the retention of communications for a longer period or unless such retention is necessary for the purpose of protecting the rights and legally protected interests of the Controller. Such a procedure is allowed by Article 6, paragraph 1, letter b) and f) of the Device.
  The IP address will be processed for the purpose of preventing attacks on the Controller's servers for a period of 6 months from the last access to the Controller's web portal. Such a procedure is allowed by Article 6(1)(f) of the Device.
• The processing of personal data is carried out by the Controller, however, personal data may also be processed for the Controller by the following processors:

Cookies - information about the processing of personal data through cookies

• The data controller, TOPGAL a.s., with registered office at Nádražní 2649/73, 785 01 Šternberk, ID No.: 258 58 891, registered in the public register kept at the Regional Court in Ostrava, Section B, Insert 2336, as the operator of this website, uses cookies on this website for the following purposes:
• measuring website traffic and generating statistics regarding visitor traffic and behaviour on the website;
• the functioning of the website
• customizing and targeting advertising, if you have given your consent to do so.

Such processing is possible on the basis of a legitimate reason - the legitimate interest of the Controller, and is allowed by Article 6(1)(f) of Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"). Cookies for the customisation and targeting of advertising are processed on the basis of your consent. You give your consent for the period of time indicated below for each marketing cookie. Consent to the collection of cookie data for marketing purposes can be withdrawn at any time by changing the settings of the respective internet browser.
• The website can also be used in a mode that does not allow the collection of data on the behaviour of visitors to the website - this mode can either be set within the browser settings, or it is possible to object to such collection on the basis of the legitimate interest of the Controller, in accordance with Article 21 of the Regulation, by sending to the contact address gdpr@topgal.cz. Your objection will then be evaluated without delay, no later than 30 days after receipt. Cookies necessary for the functionality of the website will only be stored for the time necessary for the functioning of the website.
• Cookies, which are collected for the purpose of measuring site traffic and generating statistics relating to visitor traffic and behaviour on the site, are considered in the form of a collective whole and therefore in an anonymous form that does not allow the identification of an individual.

Consent to the processing of personal data - e-mail marketing (newsletters)

• You hereby grant your consent to TOPGAL a.s., Nádražní 2649/73, 785 01 Šternberk, ID No.: 258 58 891, registered in the public register kept at the Regional Court in Ostrava, Section B, Insert 2336 (hereinafter referred to as the "Controller"), to process your e-mail address within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation").
• The email address will be processed for the purpose of sending commercial communications for a period of 3 years from the date of consent, unless you renew it.
• You give your express consent to the above processing. Consent can be withdrawn at any time, for example by sending an email or letter to the contact details of the Controller. Withdrawal of consent will result in deletion from the database and cessation of sending commercial communications.
• The processing of personal data is carried out by the Controller, but personal data may also be processed for the Controller by the following processors:

• require us to erase this personal data, - the portability of the data and the right to request a copy of the personal data processed,
• to lodge a complaint with the Data Protection Authority and the right to effective judicial protection if he or she considers that his or her rights under the Regulation have been infringed as a result of the processing of his or her personal data in breach of the Regulation.
